These Terms of Service (“Terms”) govern your access to and use of the Edgelog website (tryedgelog.com), the Execution Audit, and related tools and content (together, the “Service”), operated by Rick Castro under the name “Edgelog” (“Edgelog,” “we,” “us,” or “our”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What Edgelog is

Edgelog provides trading-execution analytics, educational content, and related tools for active futures traders. The Execution Audit is a self-assessment that produces an informational result based on the answers you provide. The Service is currently offered as a limited closed beta.

2. Not financial advice

Edgelog is for educational and informational purposes only. Nothing provided through the Service is financial, investment, tax, legal, or trading advice, or a recommendation, solicitation, or offer to buy or sell any security, futures contract, or other financial instrument. Trading futures and other leveraged products carries a substantial risk of loss and is not suitable for every investor. You are solely responsible for your own trading and financial decisions and for any resulting outcomes. Hypothetical, historical, and past performance results do not guarantee future results.

3. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use the Service. By using the Service, you represent and warrant that you meet these requirements and that the information you provide is accurate.

4. Closed beta

Access to the closed beta is offered at our discretion and may be limited, changed, suspended, or withdrawn at any time. Beta features are provided on an “as is” and “as available” basis, may contain errors, and may change or be removed before any general release.

5. Accounts & communications

When you join the waitlist or start the Execution Audit, you provide an email address. You agree that we may email you about the Service, including onboarding, updates, and offers. You can unsubscribe from marketing emails at any time using the link in those emails. Keep your contact information accurate, and you are responsible for activity that occurs under your submitted details.

The Service — including its content, design, text, graphics, data visualizations, and software — is owned by Edgelog or its licensors, and is protected by intellectual-property laws. We grant you a limited, personal, non-transferable, non-exclusive, revocable right to use the Service for its intended purpose. All rights not expressly granted are reserved.

The Service relies on third-party providers (for example, hosting and database providers) to operate. We are not responsible for the acts, omissions, or content of third parties, and your use of any third-party service may be subject to that provider’s own terms.

9. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any results or data will be accurate or reliable.

10. Limitation of liability

To the maximum extent permitted by law, Edgelog and Rick Castro will not be liable for any trading or investment losses, or for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from or related to your use of (or inability to use) the Service. To the maximum extent permitted by law, our total liability for any claim relating to the Service will not exceed one hundred U.S. dollars (US $100).

11. Indemnification

You agree to indemnify and hold harmless Edgelog and its owner from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service or your violation of these Terms.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, including for any violation of these Terms. Provisions that by their nature should survive termination (such as intellectual property, disclaimers, limitation of liability, and indemnification) will survive.

13. Governing law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules. You agree that any dispute will be subject to the exclusive jurisdiction of the state and federal courts located in California, unless otherwise required by applicable law.

14. Changes to these Terms

We may update these Terms from time to time. When we do, we’ll revise the “Last updated” date above. Your continued use of the Service after changes take effect means you accept the updated Terms.
